Riverbed Community Terms of Use

PLEASE READ THESE TERMS CAREFULLY as they will govern your use and access to Riverbed Technology, Inc.’s (“Riverbed”) Support Community (“Community”). By registering for a Community account and/or by using or visiting the Community, you agree that you are at least eighteen (18) years old and agree to be bound by the following Community terms of use (“Community TOU”). These Community TOU are in addition to (and form a part of) the Riverbed Website Terms of Use. Riverbed reserves the right to modify these Community TOU from time to time without notice. Your use of the Community following any such modification constitutes your agreement to follow and be bound by these Community TOU as modified. You agree to review the Community TOU on a regular basis and always remain in compliance.

The Riverbed Community offers you the opportunity to communicate, share and learn with other users of Riverbed products and services.

For the avoidance of doubt, use of Riverbed products and services is governed by the terms located at www.riverbed.com/license, or if you have executed a separate customer agreement, the Riverbed products and services will be governed by the terms of that customer agreement.

POSTING AND PROHIBITED CONTENT
1. Acceptable Use
  1. You agree to use the Riverbed Community for its intended purpose only, and you may not use it for solicitation or advertising purposes. The Riverbed Community is available to the public. Therefore, no information you consider confidential should be posted to this Community, nor may you disclose or solicit anyone’s private information.
  2. You warrant, represent and agree that you will not contribute any content or otherwise use the Community in a manner that:
    1. infringes the intellectual property rights or proprietary rights, or rights of publicity or privacy, of any third party;
    2. violates any law, statute, ordinance or regulation; or
    3. you should know is harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise objectionable.
2. Contributions and Content
  1. By posting to the Community you agree to be solely responsible for the content of all information you contribute, link to, or otherwise upload to this website and release Riverbed from any liability related to your use of the Community. Riverbed reserves the right to remove any content from the Community at any time, for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such content), or for no reason at all. However, Riverbed shall not be responsible for controlling or editing any content, nor can Riverbed ensure prompt removal of inappropriate or unlawful content. If necessary, Riverbed may reveal your identity and whatever information we know about you to any law enforcement agent or official in the event of legal action arising from any posting(s) made by you.
  2. If you know of usage that is in violation of these Community TOU, please let us know by contacting us here. If you believe that material or content on the Community infringes a copyright, please send a notice of copyright infringement following the process for claims of copyright infringement outlined in Riverbed’s Copyright Dispute Policy.
RIVERBED’S PROPRIETARY RIGHTS
1. You agree to grant to Riverbed a worldwide, perpetual, irrevocable, royalty-free and fully-paid, transferable (including rights to sublicense) right to fully exercise and exploit all intellectual property, publicity and moral rights with respect to any ideas, comments, suggestions, recommendations or postings that you submit on the Community.
2. You are not granted a license to any software by these Community TOU. Riverbed products are protected by intellectual property laws, they belong to and are the property of Riverbed or its licensors (if any), and Riverbed retains all ownership rights to them.
USER PRIVACY
1. In order to register and participate in the Community, you will be asked to provide personal information. Riverbed may also collect data, including personal data, about you as you access our Community, the Riverbed website and interact with us. Riverbed uses personal data we collect for two main purposes: (1) to operate our business and provide services, and (2) to send communications, including marketing communications. Any data that is stored or processed, will be done so in accordance with our current Privacy Policy and applicable laws. DISCLAIMER
1. The content and comments posted to the Community, including those of the moderators, are the personal opinions of the original authors and not of Riverbed. The content is provided for informational and entertainment purposes only and is not meant to be an endorsement or representation by Riverbed or any other party. Riverbed does not assume any responsibility or liability for any opinions or other commentary posted on this Community, the Riverbed website or any website linked to this website and makes no express or implied warranty or guarantee about the accuracy, copyright compliance, legality, or any other aspect of the content. Users of the Community agree that Riverbed is not responsible for the accuracy of the content of the Community and will not be liable for any damages incurred as a result of their use of any such content.

RIVERBED PROVIDES THE COMMUNITY ON AN “AS IS” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY WARRANTY RELATING TO NONINFRINGEMENT OF ANY INTELLECTUAL OR OTHER PROPRIETARY RIGHTS AND AVAILABILITY OF THE COMMUNITY OR OF THE CONTENT POSTED THERETO BY ANY PARTIES USING THE COMMUNITY. RIVERBED WILL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, INCLUDING WITHOUT LIMITATION, LOST PROFITS, LOST SAVINGS, OR ANY INCIDENTAL, SPECIAL, OR OTHER ECONOMIC CONSEQUENTIAL DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BY USING THIS COMMUNITY, YOU AGREE TO INDEMNIFY RIVERBED AGAINST ANY THIRD-PARTY ACTION BASED ON ANY CONTENT YOU POST ON THE RIVERBED COMMUNITY.
